## How to invest in new real estate on plan?
 
You wish to buy a property on plan, in other words the VEFA (sale in the state of future completion). As a buyer, you become the owner once the work is completed and on the day of delivery. We answer your questions: How does a VEFA sale work? What are your advantages ?

#### Projecting yourself in a VEFA housing.

The first point will be to project yourself in the housing. Indeed, if you have the possibility of visiting an apartment or a model house, this could help you.
Also, some agencies use more and more virtual reality. This is a very realistic way to imagine your future purchase, in addition to the plans of the latter.
 
#### The conditions of a reservation contract.

If you are interested in the property, you must sign a reservation contract with the seller.

#### It must contain essential and mandatory information, such as

- The living area, the number of rooms, the list of outbuildings.
- A technical note informing about the quality of the construction and materials.
- The selling price, as well as the legal conditions for which the price can be revised.
- A period of 4 to 8 months, within which the final deed of sale must be signed. In most cases, the contracts foresee that the deadline can be extended in case of bad weather, strike, bankruptcy of one of the companies of the construction site or in case of force majeure.
- The legal conditions under which you have the possibility to cancel the sale and exercise a right of withdrawal.
- When signing the sales contract, you will have to pay a deposit. This should be a maximum of 5% of the sale price, which you can negotiate with the seller. If the final sale takes place more than 2 years after the reservation, no deposit can be requested.
 
#### How do you retract?
 
After signing the contract, you will have 10 days to cancel. If you wish to cancel, the deposit will be fully refunded without penalty during this period. You will have to send a registered letter with acknowledgement of receipt to the seller as well as to the bank or the notary. The security deposit must be returned to you within a maximum of three months.
 
The final sale will have to take place before the notary, you can choose your own notary in this case, the fees will be shared. In general, these fees are 2 to 3% of the sale price for new homes versus 7% for old homes. These percentages include the notary's fee, various expenses and also the land registration tax.
 
#### The state protects the purchaser.
 
In the event of a problem on the part of the seller, the law intervenes and imposes several guarantees. The guarantee of reimbursement, in case of resolution of the sale for lack of completion. You also have the possibility of obtaining a completion guarantee, which intervenes later when the work is already advanced.
When you finally get your home, you can also claim the guarantee of perfect completion, which covers you against apparent non-conformities reported during the reception. As well as the decennial guarantee and the insurance damage work. This last guarantee will cover you against any damage that could compromise the solidity of the property. You will have to contact the insurer as well as those responsible for a claim.
 
#### The advantages of buying off-plan.
 
The most interesting point will be to obtain a home entirely in your image and customizable. This real estate will be able to respect more easily the DPE standards in force and to avoid you works thereafter, by obtaining a DPE note very advantageous at the same time for you, but also to answer the criteria of a future setting in hiring. As we have seen above, the acquisition of this type of housing is very secure and supported by the law. This is rather reassuring for you as a buyer. Also, the buyer will be able to spread out his payment with the purchase in VEFA. The construction and housing code provides for a maximum margin of 35% of the sale price as soon as the foundations are completed, and 95% of the sale price at the end of construction.
 
#### The State also puts in place various financial aids for new housing such as :
 
- The zero-interest loan
- The Action logement loan
- The reduced VAT rate (5.5%), if the property is located in an ANRU zone (urban development and renovation zone)
- The social housing allowance (ask your bank for a loan in order to benefit from the APL)
- The joint real estate lease

As you can see, this solution can be very advantageous for a future purchase.
